Terms and conditions

This document describes what we provide, what you pay and what you remain responsible for. The first three points are the ones that most often come as a surprise: read them before you order.

Version dated .

Purpose and parties to the contract

These terms govern the accounts, top-ups and computing resources that QuantylCloud offers to individuals and businesses. The identity and contact details of the provider are given in the legal notice.

The contract is formed when you confirm an order after having been able to check its configuration and its price. You must have the legal capacity required and provide accurate information.

A stopped server is still billed

Billing starts when your server first starts and runs until it is suspended or deleted. A stopped server keeps being billed at the full hourly rate: its IP address and its disk stay reserved for you as long as the machine exists.

Stopping a server therefore does not mean you stop paying. To stop paying for a server, delete it: deletion is final and releases the address and the disk.

A server whose creation failed is never billed to you.

The root password is shown only once

When a server is created, we generate a root password and keep it encrypted. You reveal it once, from your console. Revealing it permanently erases it from our systems: we can no longer give it back to you, read it or retrieve it.

Write it down when it is displayed, in your password manager. If you lose it, you can ask for a reset from the console: a new password is generated and pushed to the machine, and the same rule applies to it.

Backups: not included, available as an option

The content of your disks is your sole responsibility. Without the daily backup option, neither a deletion, nor a handling error, nor a hardware failure can be recovered on our side: we keep no copy of your data.

The “Daily backup, 7 days” option is added from the server page and is billed on top of the server, at the price shown before you subscribe. It keeps one copy per day for seven days; a restore is requested from the server page and replaces the disk with the copy you choose. It reduces the risk of loss without removing it: keeping a copy on your side is still recommended.

A snapshot, taken on demand, is kept on the same node as the server. It protects against a handling error, not against a hardware failure of the node, and does not replace a backup.

Plan your own backups, to a destination outside your server, and check from time to time that they restore.

Prepayment and exhausted balance

The service is prepaid. You top up your account, and your hourly usage is debited from that balance. All amounts shown are in dirhams, including VAT.

The hourly rate of a server is fixed when it is created: a change in our prices never applies to a machine already in service.

When your balance runs out, your resources are suspended and stop being billed. The IP address and the disk of a VPS are kept for seven days; a reminder is sent 48 hours before the deadline, then a formal notice 24 hours before. A GPU instance is kept for 72 hours, with a formal notice 24 hours before the deadline. A top-up during the applicable period restarts the resource as it was. After that period, it is permanently destroyed along with its content.

An hourly spending limit applies to your account: an order that would take you over this limit is refused before it is created.

Billing

A VPS deleted less than one hour after its first start pays the full hour, options included. Beyond that first hour, it is billed by the second, with no rounding up to the hour begun. A server whose creation failed pays nothing, and this minimum does not apply to a suspended server.

To prevent bursts of creations, an account cannot order more than 10 servers per hour, nor more than 30 servers over 24 hours, deleted servers included. Beyond that, the order is refused with a message saying so; if you need to launch more, write to us.

Dedicated servers: a full month, paid in advance

A dedicated server is a physical machine ordered for you from our supplier. It does not follow the hourly billing of VPS: it is billed per term of a full month, paid in advance, with a setup fee where applicable. The exact amount, options included, is shown before you confirm.

Your order is debited immediately, then validated by hand within one business day. If we refuse it, or if delivery fails, the amount debited is refunded to you in full. The first term starts only when the machine is delivered.

A term that has begun is due in full: there is no proration and no refund during the month, including if you no longer use the server. You can stop the renewal; the machine remains at your disposal until the end of the paid month.

The next term is debited from your balance on the anniversary date of the delivery, without any further action on your part. If the balance is not enough, we warn you 7, 3 and 1 day before the due date; once the term has passed, the server is suspended and you have 72 hours to top up. After that the server is terminated and its content destroyed, with no possibility of recovering it.

The hardware warranty is that of our supplier: if a component fails, we ask for its replacement and keep you informed, with no guaranteed turnaround time. No backup is included, as with VPS. At launch, a reboot, a rescue mode or a reinstallation are requested from support; they are not run from the console.

Acceptable use

You are responsible for what runs on your server and for what comes out of it. The following are prohibited, in particular:

  • sending unsolicited email (spam) or any mass emailing campaign without the consent of the recipients;
  • hosting pornographic content, child sexual abuse material, or online gambling (betting, casinos) not authorized by Moroccan regulations;
  • scanning or attacking third-party systems, taking part in a denial-of-service attack, phishing, and distributing malware;
  • mining, farming or plotting cryptocurrencies, whatever the protocol (proof of work, proof of stake or similar), including on GPU instances;
  • more broadly, hosting any unlawful content, and any activity that harms the reputation of our addresses.

Port 25 is blocked by default on all servers. Opening it must be requested, justified and is not guaranteed.

To protect the network and the other customers, we automatically monitor the traffic leaving each VPS. This monitoring covers only metadata — destination addresses, ports, volumes and throughput — and never the content of your exchanges or of your files.

Any abuse found or reported leads to an immediate block: we shut down the server concerned, and that server only. Detected abusive activity — scanning of ports or networks, mass sending of packets to a target, brute-force login attempts against other servers, connection to a mining pool, repeated attempts to send through port 25 — leads to this shutdown at once, without notice. Its IP address and disk are kept: no automatic deletion takes place. An email describes what was observed; you have 72 hours to reply to us, explaining the cause and what you have fixed. After that period, we decide what happens next without your reply.

This shutdown is not subject to the grace periods above: it is lifted, or turned into a deletion, after discussion with you. A new abuse shutdown within the 90 days that follow the lifting of a previous one leads to the suspension of your account: access to the console is blocked and your other VPS are shut down in the same way. In case of repeat offences or a serious breach, we may terminate your entire account, after a formal notice that has gone unheeded.

The processor of a physical server is shared fairly between the VPS it hosts. Sustained use, close to the maximum for hours, is reported to you by email; if it continues and the physical server is under load, your VPS may be throttled to half of its vCPUs, with no change in price. The throttling lifts by itself when usage falls back. Processor usage alone never leads to a shutdown.

On a dedicated server, we do not observe the traffic: complaints received by our supplier are passed on to us and handled with you. A well-founded complaint may lead to the server's network being cut off; during that cut-off, the monthly term remains due.

Resale and service bureau

The resources you order are for your own use. Resale, subletting or making computing capacity available to third parties under your own brand, on a commercial basis and without our prior written agreement, is not permitted.

Professional use of your servers for your own services — hosting a website, an application or a product that you operate yourself — remains naturally permitted.

Withdrawal, refund and termination

Consumer rights, the refund of the unused balance and the effects of your request for immediate performance are detailed in the refund policy.

You can delete a resource at any time from the console. Billing stops when it is deleted, subject to usage already recorded. You can ask for your account to be closed and for the refund of its unused balance from the contact page.

Availability and liability

We strive to keep the service available and we act on incidents. No numerical availability guarantee is attached to the service at this time. Refunds or compensation required by law and those provided for by our refund policy remain applicable.

We may change these terms. A change that concerns you is announced to you by email before it applies.

Support

Support can be reached from your console (“Support”), by email or by WhatsApp. Requests received by email or by WhatsApp are linked to your account when the address matches that of a verified account. The team replies Monday to Friday, from 9 a.m. to 6 p.m. (Morocco time), excluding public holidays.

Response times are indicative targets, not contractual. They are counted in business hours, vary with the impact you declare, and are shown on each request. They are neither a guarantee of service availability nor a commitment to resolve.

Your messages and their attachments are kept to handle your request and to keep proof of it. Attachments are deleted twelve months after the request is closed; messages are kept with your account, then for five years after it is closed. This data is processed under Law No. 09-08, solely to reply to you and to improve our service, as set out in the privacy policy.

Force majeure

We are not liable for a failure to perform caused by an event beyond our reasonable control: failure of an infrastructure supplier, widespread network or power outage, natural disaster, decision of a public authority, or any unforeseeable and unavoidable event. We inform you as soon as possible and resume the service as soon as the event ends.

Intellectual property

The QuantylCloud brand, its logo, the console interface and the content of the site are our property or that of our licensors. Any reproduction or reuse without prior written authorization is prohibited.

The data, files and content that you deploy on your resources belong entirely to you. We do not access them and claim no right over them, except for action strictly necessary to provide the service, to keep it secure, or to meet a legal obligation.

Data location and transfers

The hosting location of the compute nodes is published in the FAQ and in the legal notice once it is settled, and may change with our capacity. Where it is in a country recognized by Law No. 09-08 as offering an adequate level of protection — as is the case for the member states of the European Union — this choice is lawful without prior authorization from the National Commission for the Control of Personal Data Protection (CNDP).

The full terms of the processing of your personal data, including transfers abroad, are detailed in the privacy policy.

Electronic evidence

The technical logs, timestamps and billing entries kept by our systems are authoritative between us, unless you provide evidence to the contrary. Electronic exchanges made under this contract — order, confirmation, notification — have the same evidential value as a signed document.

Complaints, governing law and disputes

Any complaint can be sent free of charge from the contact page. We first look for an amicable solution and reply with the relevant billing information.

The contract is governed by Moroccan law. The mandatory rules protecting consumers remain applicable; no clause of these terms can set them aside.
